Sotomayor named to fill Supreme Court Vacancy

President Barack Obama has appointed 2nd Circuit Court Judge Sonia Sotomayor to fill the Supreme Court vacancy caused by retired Justice David Souter.

Sotomayor is expected to be aggressively liberal on the high court, should her nomination be confirmed by the Senate.

While David Souter was no friend of gun owners, it appears Sotomayor may be militantly anti-gun.

As a circuit court judge, she ruled in the Maloney v. Cuomo case that the Second Amendment didn’t apply to states because of the incorporation clause of the Fourteenth Amendment. Her ruling was struck down on appeal.

She also believes, contrary to the separation of powers outlined in the Constitution, that the role of the court is to “make policy.”

We can expect an aggressive form of liberal activism from Justice Sotomayor, who has said, “A wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male…”

Even Liberals have expressed some concern over her temperament and intellectual grasp of complicated cases. Liberal standard bearer The New Republic even published an editorial outlining the liberal case against her nomination.

With Sonia Sotomayor, one thing is clear; she will not be a friend of the Constitution as a Supreme Court Justice.

    The States entered into the Union of the United States of America with the understanding the U.S. Constitution was the governing document, and if changes were necessary there was the process of amendment of the document. This is not made by judges sitting on any court, but by the ratification process of the States. When government becomes so despotic that legalities are not longer recognized, we have a duty to change the government hopefully by the electoral processes. If not then secession becomes the only alternative.

    Rush Limbaugh reported today that Judge Sotomayor ruled in a 2004 case that gun ownership is not a constitutionally protected right, but he did not name the case. I have no doubt that his report is correct, knowing Sotomayor’s record, but do you have any details about this case?

  • Like some infernal VanDegraff generator, the puppetmasters behind the 0bama Machine have been “charging” its power up for at least two generations. Using the schools, welfare, and the courts, it finally has enough stored political energy to short circuit the entire US Constitution.     What exactly is “the incorporation clause of the Fourteenth Amendment”? I can’t seem to find any such word in that Amendment. Am I just blind?

    We do not need someone like
    Soyna to be on the Supreme Court. President Obama is not representing the will of the people if he chooses her. Do hope he considers this before he chooses someone who does not uphold our constitional rights. Thank you! Doyle Armer

    Nowadays,I wonder if, being politically correct and being fearful of being called a bigot by denouncing enemies of freedom if they happen to belong to a minority, trusting in an increasingly autocratic Federal government and apologizing to the world for being an American is the new religion.
    Too few of our elected officials have the guts to call a spade a spade, to truly honor the Constitution, humbly trust in God and stand proud of being the citizen of a Country that maintains freedom in the world.
    I became a US citizen by choice, I know what’s going on in the rest of the world; and what am I saying about all this ?… ” God protect us all ” !

  • You may have not intended to do so, but I think you have managed to express the state of mind that a lot of people are in. The sense of wanting to help, but not knowing how or where, is something a lot of us are going through.
