Mayor opposed to guns and civil rights

Cedric Glover, Mayor of Shreveport Lousiana believes he and his jackbooted thugs state police have the authority to wantonly violate your civil rights.

Mayor Glover believes that his brownshits state police have authority to “suspend” your rights.

Any time a motorist is stopped by a police officer, insists Shreveport, Louisiana Mayor Cedric Glover, “Your rights … have been suspended.” This includes not only the freedom of movement, but also, in the event the officer inquires as to whether the driver is carrying a weapon, “Your right to be able to hold on to your weapon and say whether [you] have a weapon or not” — as well as the right to retain possession of that weapon, should the officer decide to confiscate it from you.

Should you choose not to answer the question, or answer it in the negative, the officer could still choose, “in the interest of officer safety, to secure you in a safe position” — this most likely means outside the car with your hands cuffed behind your back — “and then do an appropriate inspection of your vehicle.”

The phrase “appropriate inspection” is more honestly rendered “Unconstitutional” warrantless search.”

Should the police officer then turn up a firearm or other weapon in the car, the driver “would be guilty or potentially guilty of even a more severe offense” than whatever he had allegedly done to precipitate the traffic stop, according to Mayor Glover. Police officers, according to Glover, are invested with “a power that the President of the United States does not have … and that is the ability to be able to suspend your rights.”

This is “one of the things that I say to each and every one of the police officers who graduates from the Shreveport Police Academy since I’ve been mayor.” Fortunately for the public, one supposes, Mr. Glover remembers the lesson that Peter Parker learned from his kindly and sagacious uncle Ben — that is, with great power comes great responsibility.”You have to understand there is a great deal of power that is vested within … the law enforcement personnel of this country,” Glover insists. “It’s why there is a great deal of responsibility that has to go along with it.”

Glover offered those remarkable observations, and many others like them, in a recorded phone call with Shreveport resident Robert Baillio

Mr. Baillio had called to complain about a recent traffic stop in which an SPD officer, who– before dealing with any other matter of business — asked if Baillio had a firearm, then temporarily seized it from him.

Louisiana law recognizes the right of the state’s residents to carry loaded weapons in their vehicles, and Baillio has a state-issued concealed carry permit — that is, a piece of paper in which the state generously recognizes one facet of Baillio’s innate right to bear arms.

According to Baillio’s account, he was cordial and polite when he was stopped after supposedly neglecting to use a turn signal. That this was almost certainly a pretext stop is illustrated by the fact that Baillio never received a ticket. Supplemental evidence is offered by the fact that the conversation between the officer and Baillio focused entirely on the issue of gun ownership, including a question about Baillio’s membership in the National Rifle Association.

Glover is a member of New York Mayor Michael Bloomberg’s Mayors Agaisnt Illegal Guns, however it looks like Glover is opposed to all guns.

    Dan: “…and I wish everybody here would stop with the constitution talk and rights talk. be grateful that your allowed to live in a free country..”. OMG – you ARE one of the koolaid drinkers. The Constitution and Bill of Rights is WHY we have a free country and it is being taken away from us by people that think and believe just like you do. Note to all you koolaid drinkers out there; how about instead of destroying this country and everything it once stood for, why don’t you just move to Saudi Arabia or Africa or Iran or any of the fine banana boat republics around the planet. No guns for the average man, they just get tortured and killed at the whim of their tyrants for any old reason (or no reason)at all. Don’t think it can happen here – think again. History has a great track record of repeating itself, and once freedom is lost it is only reclaimed at a very high price.

    The officer gave it back to him after the search. I don’t see it as too big of a deal. If Baillio rights to bear arms had been suspended due to criminal activity involving use of a deadly weapon, then the officer would have taken away a weapon that could have been used to kill someone. I’m definitely for the right to own a weapon and to carry it with appropriate permit, but I’m also for stringent restrictions on who can obtain those rights. Some people due to their mental capacity and temperament, should not be allowed to have a weapon. Baillio seemed like an alright guy and definitely in his right to possess a weapon. People with his mindset need to understand that its dangerous for just anyone to be allowed to have a weapon, especially convicts and the mentally unstable.

    All of us who served took that oath. I was a career Marine officer. Could it be that politicians and others with mindsets and actions like the Mayor, who do not recognize or agree the Constitution and Bill of Rights, could easily fall under the description of “Domestic Enemies”?

    BTW, to avoid confusion, I will also mention that I have a strong background in the legal/Criminal Justice system. I do not advocate violence. Unite and vote the “Domestic Enemies” out of office. Also, be vigilant re: the abuses of the Federal, State, County and Municipal politicians, thereby protecting and preserving the Constitutional rights that our ancestors fought so valiantly to obtain for us! Get rid of the apathy and fear that is so prevalent in the citizenry of our beloved country.

    I just returned from a trip to Sam’s Town casino in Shreveport. I am a concealed weapon holder, which I do exercise at times, mostly in my car and not on my person. It appears I should let Sam’s Town and Eldorado casinos know that I cannot bless them with myself and my money as long as going to Shreveport would jeopardize my right to bear arms!!
    It sounds as if Mr. Baililo could save a lot of problems if he would remove all the freedom and gun right stickers…..but wait that would giving up his free speech rights!!
    I think I can find a route around Shreveport and get to Bossier City.

    What are the local gun laws? Louisana is noted for making up the laws as they go along. Their local departments are involved in all manner of shake downs. They seem to have a grudge against Texans. I know many who will not go around La. Do not expect rights in La.

    I thought this was a free country.Did they return the gun???? I could understand the officer taking the gun to be on the safe side if he returned it. That Mayor will never get a vote from me. I will also make a note of Shreveport LA. as a place not to go.I thought Georgia had so back wood places but I think they top us. I wonder where the Mayor got his laws from I do not think use lose your rights till they read me to you.

    I live in Louisiana. I served my country and retired here. I am a disabled vet. Louisiana offers a lot to the vets. I have checked other states and have not found another state that offers more to the disabled. Our hunting and fishing license are free, we have free access to any state park, and our tags and vehicle license are free. Louisiana has been good to me. I live in Bossier. Many of my friends are police officers for the city of Bossier and Haughton. They are good men. Unfortunatly, the actions of one is tarnishing their image. I would be proud to stand next to these fine men and women. After research I have found police oaths state I solemnly swear that I will faithfully support the Constitution and laws of the United States of America. It appears this officer violated his oath. Mayor Glover opened himself up to criticism, with his statement concerning loosing your rights. Instead of arguing with Mr. Baillio he should have questioned the officer why he appeared to make the bumper stickers the crime instead of the improper lane change. I agree the police officer have the right to protect himself. He also had the responsibility to inforce the law. He does not have the right to harrass a citizen because of his political views or his bumper stickers. What is the difference in this and a police officer pulling over a man because of the color of his skin. Both are prejudice issues and should be addressed. Once he commented on the stickers he opened himself to complaints about police harrassment. This incident is making the state of Louisiana look bad.

    We vist Shreveport casinos as well as the gulf. I have talked to other ploice and they have no problem with gun loaded in car. I will tell the casinos to stop sending advertisements. Will not bring any cash or spend any mony in your state. I can not protect my wife and myself. I sure you are not going to look after my right to live and not be robed.

    My advice to Robert,contact the NRA and the Second Amendment Foundation asap. They sucessfully fought and prevailed over New Orleans mayor Nagin and his unlawful actions after hurricane Katrina. This action has less merit than mayor Nagin’s. In a short time you will not be the only one this happens to since it is blessed by the mayor and the police. We need to put the word out so this can be stopped. Good you documented all you did, try to note any contacts made and responses and keep for court, you will probably need them to get your gun back. May the law be with you and justice come quickly.

    this stinks of fashism, the law in Wisconsin now says a officer can pull me over because I wasn’t wearing a seat belt what if I was in a 50/ 60s car? you can’t tell. It’s another reason for them too pull you over, search you car & make as much money // possesions as possible.

    As a Louisiana citizen I understand under Louisiana law that your automobile is an extension of your residence. That being said the police have no right to search your auto without probable cause, your permission, or a warrant.

    Is ilegal lane change probable cause to search a vehicle?

    The issue is not the taking of the weapon by the officer. In the interest of officer safety that was prudent. The weapon was returned as it should have been. The issue appears to be profiling of Mr. Baillio. It is the officers right to issue or not issue a citation based on the circumstances of the stop. This has no bearing on the event. The issue is apperantly a political view of the officer and if he stopped Mr. Baillio with the intent of harrasment. Then the officer exceded his authority under the law. The Mayor just showed his ignorance. Shreveport is a city full of gang violence and drug wars. The people with the weapons that the police and the community need to be affraid of don’t get there arms from the legal course of trade and business. They get them from stealing them or buying them on the black market. The Mayor needs to practice gun control tacticts on the criminal element and not the law abiding element.

    Its always been my understanding, that a police officer must have probable cause to search someones vehicle. What did this man do to begin with? It sounds like they just decided that because of the stickers on his vehicle that he was in some way a threat. I have an NRA sticker on my vehicle too but that does not give a cop the right to search me. Where is the justice here?

    Aside from the fact that this Mayor Glover of Shreveport, circled more bushes, and out ‘good ole boyed a good ole boy’, the mentality of his rhetoric, “we comin’ to get your guns American”, is crystal clear. Where this communistic dictatorial mind set is originating from is a related issue, but a seperate subject. Regardless, this frame-work of oppresion appears to be organized, and this mayor has with political correction, draped a covering over ‘The Constitution of the United States of America’ and placed it in the same dark back-room as the Alabama Ten Commandments. I recently listened to a reading of the ‘U.S. Declaration of Independence’. This mayor and the King of England of two-hundred and thirty-three years ago sound like the same person!!!

    Let’s all take a breath and let our logic sort this out rather than our emotions.

    The police officer in question did NOT confiscate any guns. He made a lawful traffic stop in a city that has a high crime rate. And if we put some critical thought to it, we’ll realize that at this point the motorist’s rights were in fact suspended. He was not free to leave. This is what the mayor referred to when he said police have certain powers that we do not. For the public good, we have vested certain powers in members of law enforcement that “ordinary” citizens do not have. If you doubt this, go try to arrest someone today. See where that takes you. Whether or not these powers are abused is another debate altogether.

    Upon seeing pro-2nd Amendment stickers on the vehicle the officer surmised that the motorist might have a gun. This is not a stretch of imagination by any means. For safety’s sake, he took possession temporarily of the weapon. This was done in order to prevent any “misunderstandings” that could have led to a tragic, deadly-force situation. I’m sure the motorist had no intent to harm the officer, but I firmly believe it is asking too much of our law enforcement to determine who is and who is not a threat merely based on their appearance.

    As far as the vehicle being an extension of your home; that is true – to a point. The Carroll Doctrine was established by the Supreme Court of the United States years ago. This, and other case law, allows law enforcement to do exactly what the Shreveport officer did.

    Finally, upon the completion of the stop the motorist’s gun was returned to him. This is common practice by law enforcement across the country and has been in practice for years.

    There are people out there who really do want to deprive us of our guns. And not for a matter of minutes as was the case in Shreveport. These kinds of people are a real threat to our freedoms. I’m concerned that argueing so loudly and screaming about our rights being violated, when in fact they have not been violated, serves only to weaken our cause and actually drowns out our valid protests.

    Logic, rather than emotions is our best course in fighting those who seek to deprive us of our liberty.

    Wow. I was able to watch the video and I am amazed. I’m amazed that so-called 2nd Amendment “experts” have jumped on the bandwagon, screaming “Civil rights violation!”. Y’all really need to do some research on the law before you vehemently decry “our rights are being eroded”. Good grief! There are some very real threats to our rights out there, but this is not one of them.

    Much has been made of the fact that the motorist wasn’t issued a citation or asked for his driver’s license. The particular officer is assigned to the DWI Unit. His sole function is to find impaired drivers. As a matter of safety (safety being #1 on the priority list), he asked if the driver had any firearms. The driver indicated that he did have a gun, whereupon the officer retrieved it for safety reasons. This is the same procedure followed by law enforcement agencies across the country and has been for years; long before the current president even thought about becoming a US citizen. So back to our DWI officer…he retreived the weapon and made small talk with the motorist. This seemingly random conversation is an evaluation of the motorist’s impairment, if any. The officer, realizing the motorist is not impaired, feels like there is no need to ask for a driver’s license because he is not going to issue any citations. The gun is returned and the motorist is free to leave.

    Yes, the officer entered the vehicle without a warrant. This is allowed by law. There are exceptions to the principle that your vehicle “is an extension of your home”, ie. Carroll.

    We also have to look at the fourth amendment which states, in part, “the right of the people to be secure…against UNREASONABLE searches and seizures”. There is not a court in this land that would rule that an officer’s safety is an unreasonable concern, that’s why this particular officer’s very temporary seizure was within the law. He did not seize the firearm in an attempt to permanently deprive the owner of his 2nd amendment rights. The gun was returned immediately once the traffic stop was concluded.

    All of this is a theoretical exercise in constitutional law for us but that night, like every other night, that officer faces real, life-and-death situations in his effort to keep our city safe for us.

    If the motorist chooses to pursue legal recourse against the city, I predict summary judgement.

    I am a frequent traveller in Shreveport/Bossier and have been stopped several times and never once was I asked about a firearm before they asked to see my license and registration. I usually gave them both my DL & CHP registration. I was never asked to forfeit my gun. What a ridiculous thing for the SPD to do and that Glover is a real idiot. It just goes to show you what happens when we don’t take our voting responsiblity seriously. We get persons who are ignorant of the law in the positions of power and it all goes to hell.

    it is time for use to use hte law where it backs. if the police take a firearm with out the back of the written law it is theft. they can say the mayor order it will a peace office are not to follow unlawful orders. after the office take you fire arm ask him to call the state police to you location. if he ask why let jhim know you are goingto fill a thrft report of a fire arm. just becase he has a bage does not allow him to take the law in his own hands. if it is a order for the cange of commaned the it falls under the reco act.
    if you do not want to dp at the time they are taking your gun. do it latter. when the police see thay could go to jail for following unlawful orders they stop following them.

  • I admire the jobs the police do and I want to help protect each and every one of them.
    I also possess a concealed weapons permit. I have no problem with an officer holding my weapon if I am being questioned. As long as he got his weapon back immediately after determining there was no threat is the important thing.

    Though I am a firm believer in stricter gun laws, this is reprehensible. The police officer had no right stopping this man since it was clearly about the stickers on the truck. This is clear bigotry and abuse of power. As for having one’s rights “suspended” when stopped by a police officer – - – since when? Does that mean if I get stopped that the officer can strip search me? Guilty til proven innocent I guess.

    I didn’t read whether or not the firearm was returned to Mr. Baillio. I hold a CHL in the state Texas. The law requires that if I am stopped for any reason and asked for ID, and if I am in posession of a firearm at the time, I am required to produce my concealed handgun license at the same time without being asked. At that time, at the discretion of the officer, I may have to produce, and possibly surrender, the firearm until I am allowed to continue on my way. But, they can’t keep it if everything is legal. They will give it back. I don’t like it, but if I want to retain my CHL, I have to abide. In many ways, holding a CHL is a double edged sword.

    Shreveport is obviously a different story. You have a fool for a mayor that doesn’t even know the laws for his state, has a chip on his shoulder, and runs his town like he runs a back alley dice game. His dice, his rules. Welcome to Porky’s. You have no rights if that’s what he chooses (he thinks). Some of his police officers follow his example like puppies. It’s unfortunate that the ACLU picks and chooses who’s civil liberties they want to defend. If they were honestly protecting liberty they would be all over this. Don’t get me started on those commies.

    I am appalled at what I just read! The right to keep and bear arms is a fundamental freedom and no one can legally confiscate a gun under the aforementioned circumstances. I am a retired woman and have used firearms all of my adult life………no one has ever been hurt. Americans, you had darn well better wake up NOW! We citizens reject the assertion that any public official can articulate/rationalize/restate/spin/repackage/market/negotiate our rights as citizens of the United States of America. They were endowed to us by our creator, not a human being, not a President, and certainly not a sheriff. They are non-negotiable.

    What happened to probable cause to warrant a search? I, as a female, have learned not to volunteer any information not asked of me. In light of the constant fight to disarm citizens, and this story, I would not allow that I had any kind of weapon!

As we all know and understand that socialism and communism starts in the same fashion as this incident did. A casual encounter for a driving violation….then BOOM you surrender your legal weapon to the gestapo. this is a vile act of the 2nd ammendment which in my eyes super-cedes any state law on the books in any state. I for one am deeply upset and ashamed that this man has not retained a lawyer to sue the city of New Orleans and the fat ass mayor or cheif of police and file a federal suit against the state.

    That mayor Glover, and the confiscating officer, should be fired and run out of town. This person was clearly stopped because of the bumper stickers he displayed on his vehicle. “Your rights are suspended” is such a rediculous statement by the mayor. I have no problem with an officer wanting to see my weapon, but I will unload it before handing it to him.
    I was told by a former officer to NEVER hand a loaded weapon to a police officer, since he has never held that particular weapon and is not familiar with it, it could accidently discharge and result in your or his injury or death.
    This was a clear case of “Boss Hogg” mentality and needs to be eliminated.

  • When you are stopped by a officer of the law and you are in this situation, you can feel soooo helpless. My wife was stopped in a hic area of Fl. one time for speeding when she wasn’t, she was charged with doing 79 in a 65 zone. They never even dreamed that we would go 275 miles to show up for court, but we did. In the hearing the officer had to be sent out of the courtroom by the judge for wanting to whip me!!! Guess what, the judge threw it out!! I know that the good ones far outweigh the bad but goes to show you there are some bad ones out there. GOD help you when you get one of the bad ones and he has a stupid mayor backing him!!

    I don’t agree with concealed carry permits. It just gives these tyrants the knowledge that you are a gun owner. They will never convince me that gun control is about saving lives. Their lives maybe when they are robbing you of your rights.

    When they come after you with their guns, you better be prepared to use your gun. When cops refuse to differentiate between criminals and criminal activity and law abiding citizens exercising their Constitutional Rights, we have become a police state and the police will only serve and protect their owners, the bureaucrats. They DO NOT serve and protect the public. They are an armed enforcement arm of the government.

    I would sue! Period. I would sue the Mayor, the Mayors office, the local police department and the police officer! I would also use the press. And the next time I simply would not hand over my firearms. You have rights regardless of what the police/government say. You as a citizen of this republic are guaranteed these rights. If you fail to stand up for these rights than they are meaningless and these people in power know this. If know one takes a stand when challenged, than 230 plus years of sacrifice mean nothing and the government, whether local or federal will decide your fate and we will no longer be a government by the people and for the people, but a government unto the people and nothing more than subjects.

    Maybe it would help to be clear about language.

    No person, no entity,not even God Himself can “take away” your rights.

    What happens is that other people or entities (i.e. “groups
    of people”) threaten to kill you if you exercise your rights.
    And that’s all there is to it. You’ve been threatened, with
    pain and or death, if you choose to exercise a right.
    And you’re presumably choosing not to exercise those rights -or worse, to argue about how many angels can dance on the head of a pin and pretending it’s Doing Something Useful.

    Am I advocating armed revolution? Nope. You’re outnumbered,
    outgunned, and demoralized. In any sort of serious combat
    you are skaaaarewed beyond discussion, given that
    “demoralized” part.

    The tyrant’s propaganda has you believing you live and die on his whim, not your own. And without a cause to adhere to, and a willingness to die for service to that cause, then any sort of warfare is flat out.

    So all you have left are the “tools” that the enemy has given you, and you can see how well those work.

    So keep on writing to the guys who’ll cheer if you’re killed
    [i]pour encourager les autres[/i].

    Keep on griping that somehow lawyers should “fix things.”

    Keep on pretending that freedom is anywhere but in the
    rear-view mirror, and that there’s something coming ahead
    besides a drop off a cliff.

    Liberty for one means liberty for all, or it’s not liberty -
    it’s license.

    I was pulled over by a Louisiana State Police on I 10 next to the LaPlace exit coming from New Orleans. I was stopped for speeding. I exited my vehicle and walked to the troopers car. He said for me to get my insurance and registration and bring it back to him. I informed him that I had a pistol in my truck. He said that’s OK just go get the information I asked for. I got the information, gave it to him, he looked at it and gave me a ticket and off I went. This happened about 15 years ago. My how times have changed!

    Please extend this to Mr. Robert Baillio, Sir this is why you must run for Mayor at least or Sherrif in a Parish (see a real Yankee did not call it a county)of your residence, in order to use your power in government to stop this abuse by government in and around where you reside. You must run for election to ensure it is laws of men over tyranny by government.
    Mayor Glover is wrong headed in this approach and careless in his adherance to the respect for those he was elected to serve. Good luck!

    My experience in GA started with passing a woman who pulled out in front of me causing me to slam on my brakes. I admittedly blew past her giving nothing more than a dirty look and was promptly pulled over by Gwinnett Police. I believe the cop saw my carry permit behind my license and asked if I had a gun in the car. I did and told him I did. “Where is it?” “In back in my duffel bag.” He instructed me to unlock the back door and rifled through my bag to retrieve my .40 S&W. I produced my carry permit, but it was the expired one and he nonchalantly walked to his car and called in the troops (2 additional cars- cops with hands on guns watching me). I asked if there was a problem and he replied my permit was expired. I rustled through my wallet to find the replacement and they all relaxed. After getting lectured for my poor passing “without a turn signal” manuever, he claimed he could arrest me for road rage and it would be a felony because I had a loaded gun in the vehicle. I believe this was hogwash, but i didn’t argue because I didn’t want a ticket. Then, he let me off with a warning, probably knowing he had no case in court.

    Keep in mind I had not cut her off, did not gesture or yell at her, I just glared as I passed her. I did not use my signal, so I was a bit in the wrong, however I would not classify my actions as remotely being a case of road rage. On the other hand, I did NOT give him permission to search the car, and while I think police should protect themselves, this was surely a case of heavy handedness on his part. My guess is that one of his compatriots told him he had no right to search the vehicle. His road rage comment was to scare me- which it did. In all of my previous traffic instances, I always made it immediately clear that I was carrying a gun. Of the three- speeding (once), a safety check (more likely a DUI checkpoint), and a DNR check, two of the officers took the gun until they did their business and returned the unloaded gun and loose bullets afterward. The cop at the DNR check laughed and said “they’ll get over it.”
