Cedric Glover, Mayor of Shreveport Lousiana believes he and his jackbooted thugs state police have the authority to wantonly violate your civil rights.

Mayor Glover believes that his brownshits state police have authority to “suspend” your rights.

Any time a motorist is stopped by a police officer, insists Shreveport, Louisiana Mayor Cedric Glover, “Your rights … have been suspended.” This includes not only the freedom of movement, but also, in the event the officer inquires as to whether the driver is carrying a weapon, “Your right to be able to hold on to your weapon and say whether [you] have a weapon or not” — as well as the right to retain possession of that weapon, should the officer decide to confiscate it from you.

Should you choose not to answer the question, or answer it in the negative, the officer could still choose, “in the interest of officer safety, to secure you in a safe position” — this most likely means outside the car with your hands cuffed behind your back — “and then do an appropriate inspection of your vehicle.”

The phrase “appropriate inspection” is more honestly rendered “Unconstitutional” warrantless search.”

Should the police officer then turn up a firearm or other weapon in the car, the driver “would be guilty or potentially guilty of even a more severe offense” than whatever he had allegedly done to precipitate the traffic stop, according to Mayor Glover. Police officers, according to Glover, are invested with “a power that the President of the United States does not have … and that is the ability to be able to suspend your rights.”

This is “one of the things that I say to each and every one of the police officers who graduates from the Shreveport Police Academy since I’ve been mayor.” Fortunately for the public, one supposes, Mr. Glover remembers the lesson that Peter Parker learned from his kindly and sagacious uncle Ben — that is, with great power comes great responsibility.”You have to understand there is a great deal of power that is vested within … the law enforcement personnel of this country,” Glover insists. “It’s why there is a great deal of responsibility that has to go along with it.”

Glover offered those remarkable observations, and many others like them, in a recorded phone call with Shreveport resident Robert Baillio

Mr. Baillio had called to complain about a recent traffic stop in which an SPD officer, who– before dealing with any other matter of business — asked if Baillio had a firearm, then temporarily seized it from him.

Louisiana law recognizes the right of the state’s residents to carry loaded weapons in their vehicles, and Baillio has a state-issued concealed carry permit — that is, a piece of paper in which the state generously recognizes one facet of Baillio’s innate right to bear arms.

According to Baillio’s account, he was cordial and polite when he was stopped after supposedly neglecting to use a turn signal. That this was almost certainly a pretext stop is illustrated by the fact that Baillio never received a ticket. Supplemental evidence is offered by the fact that the conversation between the officer and Baillio focused entirely on the issue of gun ownership, including a question about Baillio’s membership in the National Rifle Association.

Glover is a member of New York Mayor Michael Bloomberg’s Mayors Agaisnt Illegal Guns, however it looks like Glover is opposed to all guns.

  • I am a 64 year old male that has had access and used “guns” since before I was in “double digits and none of my guns have EVER jumped up and shot at anyone. Gee, it sounds like I have well trained guns. I also used to own and operate several cutlery shops and none of my knives ever jumped up and cut anyone. Is that a miracle? Bob

    I live in NY, and we have license requirements for handguns. I’ve only been pulled over a few times in over 40 years, but NEVER asked by the officer if I had a weapon.

    You know, the Obama administration has an unspoken persuasion about guns that I think make us all a little nervous…you know….”they cling to their guns and their religion….” or “the cops acted stupidly…”. You can feel it. The people in this present administration and others in the past keep prodding the citizens who either love shooting (I shoot competitively) or just want the ability to protect themselves and families – I do that too. I belong to the NRA because of this mentality in our government. We always feel the pressure of anti-gun nut jobs who think that taking guns from all of the lawful citizens will somehow make the country a safer place. Not true. We all know the criminals will still have their (illegal) guns…..they have them now with all the current tough laws on the books!

    I appreciate what the police go through….I have a close friend who is a police officer and was shot in his vest responding to a call about nut job with an illegal gun.

    When police act heavy handed or overstep their boundaries, then there is concern, like I said, reinforced by the politician’s stupid view of firearms. I think the POLICY here – as the mayor describes it – “all of my rights are suspended when I’m pulled over???? Is unconstitutional. Comon. I have the right to remain silent don’t I? I chose to carry on an intelligent response with the officer the few times I’ve been pulled over.

    New Orleans/Louisiana law enforcement people did this during Katrina. They were properly chastised for it later when the state passed laws protecting law abiding citizen’s 2nd amendment rights – even in times of emergency. That’s when we need them the most apperantly considering all the looting and breakins that happened in the aftermath of Katrina. Perhaps this Mayor should get a call from Gov Bobby Jindal and get a tune up.

  • Certain cops and mayors behave like fascist thugs because they can get away with it. They get away with it because almost everyone in the judiciary, the legislature, and executive branches of government, at all levels (local, state, and federal)share the fascist sentiments of these cops and mayors. The same could be said of the mainstream media. Therefore, there are no reprisals, judicial, legislative, or otherwise, against these fascist thugs.

    They have to feel pain to change. They feel pain when they lose elections. The “tea party” movement has been the most effective change agent in this country within recent memory. Drive this pig from office, and make sure the newly elected mayor fires the entire police department, and replaces them with new recruits that actually understand constitutional limits to executive branch power.

    In order to enslave a nation: first, disarm it. Any government or government agency that follows this format is not a true American, and does not truely observe the spirit of the American Constitution or honor and respect the American founders and framers of the our constitution. I can understand a law officer using caution when confronting someone in the act of enforcing the law, especially on the hi-ways. But, when one is cooperating with the officer, and being straight with him/her, there is no reason for the officer not to be cordial and respectful. The laws of firearm ownership and posession are clear and straight forward, in most instances. Several years ago, I was visiting in Texas, and was involved in an accident when a guy pulled out in front of me. The Texas officer who investigated the incident watched me unload my vehicle and put the items into the car of the one who was assisting me at the point of the accident. The officer saw me take my rifle and hand gun from my vehicle and put it into the other one. He didn’t question me or show concern in any way; didn’t even ask me if either was loaded or not. Is that not the way it should be–in America? I would not have been upset with him if he had shown caution, which I am confident that he might have been. I will say, that he won my admiration as a true professional.

    This is how I see it. Our fore fathers Fought to overcome British rule, so we could have the rite to practice our religion, protect ourselves and our loved ones and to ward off any threat to this wonderful country. There have been crimes, horrible crimes, using guns over the last few years. This was not caused by the freedom to carry a gun. It was caused by, among other things, the removal of God from society through the misuse of the constitution. In 1963 the most common behavior problem in schools was chewing gum. This was the same time God was removed from the public schools. Now we have huge amounts of underage pregnancies, gang fighting, foul language and much more. Gun carrying is almost the norm in many schools. What really happened was that the governmnt removed absolute right and wrongs when they kicked God out. This led slowly but surely to a near anarchy in kids minds. Whats wrong for you may not be wrong for me. And so we now have alot of lost kids who in some cases act out physically and at times with guns. And so now the liberals have their reason to remove the rite to carry a gun. They claim to be concerned for our welfare but they are really trying to disarm us so they can take us to a way of life that was not intended and was protected against by our Constitution. The liberals do not like the United States as it was created. Ask Obama what the alinsky method is. He practiced this and trained others on the same. I,ll let you research that yourselves.

  • First comes the law suit in federal court for violation of your rights. Illegal search and seizure also file with the district attorneys office in Baton Rouge to persue this matter. We just won a $600,000 suit against the police dept. for violation of the 4th and 14th amendments, illegal search and seizure. So it can be done.

    Today I received Dudley Browns “Action Alert” e-mail that contained shocking information regarding the alleged “abuse of power under the color of authority” by a Shreveport Louisiana Peace Officer, because the Officer pulled over a citizen (Mr. Baillio) for allegedly “failing to use his turn signal” and then confiscated a firearm that was in the lawful posession of that citizen, even though that the citizen (Mr. Baillio) was clearly in posession of a CCW liscense, and in compliance with all laws concerning such Concealed Carry requirements.
    I listened to the audio of the conversation between Mr. Baillio and the Mayor of Shreveport, as well as read the blog that is posted on this site, and then combed over a large majority of the comments in response to this incident that have been deposited on this site.
    I have to say that I feel a bit cheated though… I was looking for information in the discourse that would indicate to me whether or not the Officer upon completing his encounter with Mr. Baillio, appropriately returned the firearm back into Mr. Baillio’s possession before releasing him, or simply kept it and sent him on his way.
    Without this interesting tidbit of information, we are left to assume that the Officer unlawfully deprived Mr. Baillio of “life, liberty, or property, without due process” as it says in the Constitution, and that Mr. Baillio’s constitutional rights were violated in the most extreme way… I feel that the story is a bit embellished, because this little interesting tidbit of information was left out, and thereby leaves the reader to assume that the Officer confiscated the firearm, and did not return it.
    If it was the case that the Officer had kept the Firearm, and sent Mr. Baillio on his way, then all of us would have just cause to be extremely alarmed… but Mr. Baillio did not accuse the Officer of doing that, and I’m sure that if the Officer had done that, Mr. Baillio would have made that clear, and we would be altogether “bitching” about an intirely different issue… and more than likely “up in arms” about the whole matter… even more so then we are right now.
    Mr. Baillio, in fact, asserted that he wasn’t even given a ticket after the whole incident before he was sent on his way.
    My conclusion based on what I’ve observed is this… The fact that Mr. Baillio felt uncomfortable about the whole procedure is intirely irrelivant to me, seeing that the Officer handled the encounter well within the realm of what a “prudent person” would expect of any law enforcement official who has made “legal contact” with anyone who has allegedly violated public safety laws, and then reveals to that Officer that he is in posession of a weapon that the officer would naturally perceive could possibly present a danger himself (the Officer), or the public while the enteraction takes place… remenber, the Officer has never met this individual before, and does not know the nature of the mental state of the person he is making contact with.
    Temporarly securing that weapon during the encounter would be a “prudent” thing to do until you confirm the legality of the “possession”, and you confirm, that the person you are interacting with is not a “moron” and a “nut case” that is going to put your safety, and the safety of others in jeopardy during the encounter would be a “prudent” thing to do also.
    Lets face it, there are a lot of morons out there that have bumper stickers on their vehicles that reflect their love for their 2nd Amendment rights, who make folks like you and I look bad… and that do, and say things that would make even you withold issueing them a permit to carry a weapon.
    The Officer, under the auspices of a “legal contact” (no use of signal), simply took the opportunity to shift the focus of the contact to validating the condition of Mr. Baillio’s “right to carry”, and then returned his firearm to him, and released him without giving him a ticket for the traffic violation as a reward for his generous cooperation… What a deal!
    The Officer did not see him as public enemy #1, and if he saw him on the road again, probobly would not feel the least bit threatened by the fact that he knows that Mr. Baillio is carrying a concealed weapon.
    With respect to what the Mayor said on the audio recording… There was not a single word that he said that I could take issue with… nothing that violates the spirit or letter of the law.
    I would not have a problem with any law enforcement official confirming or validating my “right to carry” condition during a “legal contact” if I had a CCW permit… or with his use of securing that weapon until he completes his investigation… I would not view that as a violation of my Constitional rights, unless he ultimately deprived me of my “property”, “without due process”, and failed to return my firearm after finding out that I was not in violation of the law.
    I’m sorry that I can’t take issue about this particular incident like everyone else, but your gonna have to find a better senario then this one to get me all worked up and barking.

When Obama declares martial law he doesn’t want any American citizen to be able to fight back, it is just that simple. My father fought in World War II also, he was gone for 4 years fighting for our rights, and now it counts for nothing. Americans are doomed, and they don’t even know it.

    Here in Pennsylvania, the legislature has done an end run around our state’s Constitution with the Motor Vehicle Code. The Constitution states in Article 1, Section 21, Right to Bear Arms:
    The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.

    Furthermore, it states in Article 1, Section 8, Security From Searches and Seizures: The people shall be secure in their persons, houses, papers and possessions from unreasonable searches and seizures, and no warrant to search any place or to seize any person or things shall issue without describing them as nearly as may be, nor without probable cause, supported by oath or affirmation subscribed to by the affiant.

    1. The Pennsylvania Motor Vehicle Code is “code”, not law, therefore all Pennsylvania Constitutional rights which mention “law” are not applicable.
    2. Violations of the Pennsylvania Motor Vehicle Code are “summary offenses”, not “crimes”, and our Constitution only covers crimes, so it does not apply to Motor Vehicle Code violations.

    The police can do anything they want if you’re in your car, and you have NO Constitutional challenges whatsoever in Pennsylvania.

    I just took a carry permit class in Tennessee. They showed a video doing exactly what this policeman did. Police officers are justified in “protecting” themselves by disarming us, even if you have a carry permit. I have a friend who was stopped for speeding. Unfortunately, he stupidly stopped in a school zone while school was still in session. He proudly handed the officer his license with the carry permit card on top. The officer ordered him out of the car at gunpoint. He was cuffed and ordered to stay on his knees while the officer retrieved his gun. After describing this to my instructor he told us to be prepared to do the face slam on the pavement as police have the authority to “protect” themselves. And many of them hate the carry “privilege”, which we call a Constitutional right. If the policeman confiscated the gun with no felony crime, then and only then would he have been in trouble.

    certificate that a title exists. But, the title is not in your possession, because it remains with the state. There are many fascinating things like this in law.
    The only way to get justice is to threaten a lawsuit that may expose one of their schemes to take away something that we own. It probably takes a huge public outcry.

    After listening to the tape I cannot support your conclusions. I am a NRA member also a former Marine and police officer. The mayor used some terms like “rights suspened” that sounded off but the general idea was right. A officer should be able to protect themself and control the situation. The gun was returned and I don’t see what the problem was. In my opinion this guy showed his true colors when he started talking about selling alcohol to underage kids. To me the mayor sounded like he supported the police and spent a good deal of time talking to the “citizen”. We should save our battles for when they really count like what happened after Katrina.

    Actually, the officer was right. Mr. Baillio had committed a minor traffic offense. The officer did what officers are supposed to do and that was to pull Mr. Baillio over and inform him that he had committed the offense. Everything else is smoke screen. The officer has the right to know if the individual is armed and where the weapon is located. He may also temporarily seize the weapon if it is clearly visible or represents a threat to him. If the weapon is concealed in the car, he may not seize it without a warrant. The may is guilty of being stupid. He should not be trying to answer those kinds of questions himself but should have referred Mr. Baillio to the city attorney or the chief of police. If someone does the wrong thing either the police or the citizen the case usually ends up in court. An illegal search and seizure will have the case thrown out of court in which case the citizen can then go after both the police department and the officer. A weapon in the hands of an irate citizen who doesn’t like police can discharge killing or wounding the police officer in which case the citizen would go to prison where his rights are temporarily suspended until after he returns to civilization. In any case, there are no winners when people either citizens or officers are challenged and a firearm is used to determine the outcome of the confrontation.

    Prima facie, the only “probable cause” for the officer to initiate the stop was the presense of pro gun and patriotic stickers on the victim’s vehicle, which of course was invalid. Therefore, all subsequent actions by the officer were invalid as well and a violation of the victim’s civil rights. During any interaction between an officer and civillian who may be armed, even legally, the officer has the right to TEMPORARILY remove the weapon from the civilian’s possesion if he fears for his safety. However, once the reason for the interaction concludes and the civilian’s carry status has been verified, the officer has no right to confiscate the weapon. It should be returned immediately and directly to the civilian. It seems that the only goal of the officer in this case was, by policy, to harass the victim for his display patriotic display. This official behavior, along with the government thuggery that occured after Katrina only serves to perpetuate the perception of Luisiana as America’s ‘Bannana Republic’. I hope Mr. Baillio is intent on filing suit against the Mayor, the City and the officer.

    I agree with George from the OC and Sahawna …. I am a former Marine and street police officer and now manage contract security staff that make “stops” on secure contracted “private” property.
    This “issue” as presented is not an event that gets my blood boiling. As to Mr. Mayer’s comment, I dare say that if I were still guarding a president and I ordered you to turn over your weapon, believe me, you would. Here in Virginia CCW are tied into the DMV process, so an officer can run a plate and know that at least the possiblity exists that the operator of the vehicle may be legally carrying a conceealed weapon. Further, when hunting and a Game Warden or other enforcement person requests that weapons be seperated from persons that are openly displaying same, it is expected and probably a GOOD idea to comply with the request. In Virginia a person may lawfully openly carry a gun in public, now I think as a police officer I might stop and question that person so the same expectation mentioned above applies. So as a matter of common sense it should also apply to a person tha has a CCW. I’ve been stopped at sobrity check points and hand my CCW permit to the requesting officer if indeed I am carrying. I may not always agree with the terminology that was used or some indicators that were presented in this event, but to me it is a common and professional courtesy to the officer to make the officer aware that there is a weapon and it deminishes the opportunity that there could be an “issue” between the officer and myself. By the way, as an aside, my wife also carries so, if she is carring, her’s is presented as well.

    After reading and listening all the way through the recording alot of you evidently don’t live in the South. I’ve been pulled over and questioned before about having grenades bombs cannons and what ever and even asked if I had a weapon in the car several times involving a traffic stop.Sometimes the officer will ask me to sit in his car while he checks my pistol and unloads it. No problems there and sometimes they just say to me not to reach for my gun if it’s in the glove box. Maybe I’m wrong but I don’t see this as a threat to my rights. This guy in Shreveport was given his gun back at the end of the stop.
    Now harm no foul there. the Officer was trying to protect both of them from any chance of harm. A minor inconvenience to the guy but the Mayor was a joke.And this guy was trying to blow this out of proportion my two cents worth and I don’t see a lawyer jumping on this.

    I proudly display a bumper sticker that states I will keep my guns, my money and my freedom and you can keep the change. I am tired of the government telling us what we must do, what we cant keep and our rights steadily being taken away. The government states that we shouldnt be profiling illegals, well Ima citizen and I resent being profiled because I believe we have the right to have guns. I live way in the country in West Texas. We have snakes, bobcats and other critters that can cause us harm. What am I suppose to do throw a shoe at them. I challenge one of these big government officials to come live out here gunless and see what happens maybe a rattlesnake will get them, or they will be gored by a wild hog, or bit by a rabid animal. They would be getting what they deserve. We have no animal control out here to call

    This is a blatent attempt to snub his nose at the Constitution for the purpose of his own political opinion. Glover has no respect for our rights and therefore should be removed from service. If this “policy” is not recended, I will encourage Texans, especially us gun totters, to discontinue visiting and leaving our money at the entertainment facilities in Shreveport/Bossier City. We will also start petitioning the casinos for their assistance as they are the largest source of revenue in that state.

    Responsible gun owners, keep us all safer … not rogue cops and runaway power grabbers like Chief Glover.

  • Read the federal constitution folks. The 14th Amendment created a new citizenship status of US Citizen (servant of the federal government). Any time you sign a federal document declaring your citizenship you agree to be accept it’s civil rights and surrender your unalienable rights. That’s how you “consented” to the federal contract.     The Bailio v Glover issue is a state’s rights issue, not a 2nd amendment to the federal constitution issue. What does the state constitution have to say about gun rights? The states created the federal, state trumps federal. Hitler’s propaganda minester said, repeat a lie a thousand times, and people will begin to believe it. In this society we have government by the consent of the governed. The power is with the people. We are the self governed. When we allow our servants to tell us what to do, we have a problem.

    I am going to do it and suggest to you all to do it as well. Call and keep calling that Mayor’s Office and even the Police Office (not 911) about your objection. Jam their lines and voice mails to the point where they might start ignoring them and when that happens when someone calls about a different issue they will be ignored and Mayor and Chief of Police don’t get re-elected.

Its simply profiling, and being that Mr.Glover is part of Mayor Bloombergs Mayors against guns and a typical liberal moonbat he will find some rediculous way to protect his hide. They know they have you by the balls, and figure that it will cost to much to fight for your right and that you will just drop it. The Mayor of Shreveport and the police department need to be made an example of and exposed for the blatent violation of citizens rights. This is the beginning, first they disarm you then walk all over you.

    This is just a sign of things to come I am afraid. I was not one to jump on the prepper bad wagon and think ill of even the most Progressive of governments. I will be buying my first of many weapons shortly. Lord I pray that I never have to us them in this life.

  • It is highly suggested that when pulled-over for traffic stop in my state that you present your CHL with your DL.
    The LE officer will be calling in your DL# anyway and it will come back with the fact that you possess a CHL.
    So it is a courtesy to the officer. I believe (not certain) that it is that officer’s right to see and even look at your concealed handgun. Most may ask if you have but few will ever ask to see it. As a responsible CHL holder, I would NEVER give ANYONE my LOADED handgun. If requested, I would say as I was doing it that I was unloading the firearm before passing it to the officer. Make sure all your movements, intentions and words are slow, deliberate and easily understood. It sounds like the good citizens of Shreveport need to start recording all conversations in their cars and on their phones because “big Brother” is alive and well there.

    Is it just me or do you all find it weird that crime goes up in this country an our rights go down the toilet? If we had a government true to this country’s cause “FREEDOM” they would be more interested in it’s citizens being safe and ready to defend themselves against crime or an outside threat!!     While all of you were sleeping or labeling people “the criminals” the federal government has made a law that any one convicted of a felony loses there 2nd amendment rights for life. People make mistakes thats what makes us human so while you were wearing your wifes skirt cryin for the Gov’t to please keep me safe they achieved one more step in destroying the constitution. I think once a person serves there debt to society all rights should be reinstated and if they continue to break the law then penalties should be increasingly harsher.     Oh and you all obviously need to reread the 2nd amendment, particularly the last for words “shall not be infringed” If you dont understand what infringed means then you are just stupid and deserve what you get for they have already succeeded in dumbing you down.     The worst thing I can imagine is living in a country where only the police and military have guns. Even if that was the case you can bet your last cent that people like Pelosi ,Reid, Obama,Kennedy and all the anti gun crowd would have them too, or their body guards would. Does anyone else remember years ago in Washington DC, with its ban on guns, Ted Kennedy’s body guard was caught with hand guns and a Uzi ? It made the papers ever so briefly in Texas before being swept under the rug. D Senator Fiend-stein the blatant anti gun nut was one of only 2 people issued a CWP in San Francisco in 6 yrs,And of course with out having to take the training class. Her husband got the other ! In 10 days you will only be able to buy 50Rd’s of pistol ammo a month with a Id and finger print.     I have seen alot myself after delealing with other parts of U.S. Government (USDOE). I was a contractor for USDA at Savannah River Site.
    I am also a honorable Discharged Veteran who worked behind Iron Current when the wall was up and also worked for Westinghouse SR. Government attornies and the yes men and woman that work for the U. S. Government that have sold their souls to devil and sold many working men and women out. This country is going down the tube fast I see it every day. I can only pray that come November 2nd that voters will remmeber to take ou the trash and hopefully we will try and get back on the correct path forward. Respectfully W. D. Hooker Sr retire.

    I usually don’t agree w/ Mayor Glover, but he’s being set up here. Mr. Baillio should complain to the State of Louisiana, NOT the mayor. I’m a pro-gun rights, card carrying member of the NRA, but it is clear that any issues with this law are with the state. The Shreveport Police are justified in their actions according to state law. The Louisiana State Police website clearly states that a cc permittee’s duties are:

    The permit shall be retained by the permittee who shall immediately produce it upon the request of any law enforcement officer. Anyone who fails to do so shall be fined not more than one hundred dollars. Additionally, when any peace officer approaches a permittee in an official manner or with an identified purpose, the permittee shall:

    1.Notify the officer that he has a weapon on his person;

    2.Submit to a pat down;

    3.Allow the officer to temporarily disarm him.

    The only angle that you could pursue has to do with a Louisiana Resident’s automobile as an extension of the home. A question you might consider asking, “If I am not concealing a firearm on my person, do I still have to submit to the laws regarding concealed carry?”

    p.s. The idea about being pulled over because of the bumper stickers doesn’t make a whole lot of sense because the traffic stop was at night. Have you ever tried to read a bumper sticker at night while driving down the road? I hate to be the one to debunk this story because I do truly believe that our 2nd Amendment Rights are under attack and must be defended, but everyone involved did exactly as they were supposed to. If you don’t like the law/outcome, then you probably need to talk to state politicians and have the laws changed.
