National Association for Gun Rights Files Lawsuit Against Illinois Gun Ban

The National Association for Gun Rights has expanded their lawsuit against the City of Naperville, Illinois to include the state semi-auto ban, and is asking for a temporary restraining order.

Springfield, IL – Today, the National Association for Gun Rights amended their lawsuit against the City of Naperville, Illinois and their proposed “assault weapons” ban to also include the state of Illinois’ ban on semi-automatic firearms, and filed for a temporary restraining order to block the new law’s enforcement statewide. The amended complaint comes in light of the Illinois General Assembly passing a state-wide “assault weapons” ban which went into immediate effect with the signature of Gov. J.B. Pritzker on January 10th.

The new Illinois law bans the sale of most semi-automatic firearms, standard capacity magazines, and requires law-abiding citizens to register their currently owned firearms with the state.  

“Semi-auto and magazine bans are blatantly unconstitutional. This bogus law violates the Second Amendment rights of law-abiding citizens in Illinois and directly flies in the face of the Bruen decision issued by the Supreme Court seven months ago,” said Dudley Brown, President of the National Association for Gun Rights. “We were already suing Naperville and Highland Park over their gun bans, so amending our complaint to sue the entire state of Illinois was a no-brainer.”

The U.S. District Court in the Northern District of Illinois granted the motion to amend on January 23, 2023. The National Association for Gun Rights is also asking the court to issue a temporary restraining order and preliminary injunction to block the statewide gun ban.

“With the decision handed down in Bruen, laws like this one must find their justification in the history, text, and tradition of the Second Amendment – and a wholesale ban on the most popular firearms in America is unjust and unconstitutional. These laws ban firearms that are in common use throughout the United States in violation of the test set forth in Heller. We look forward to demolishing this draconian law and restoring the gun rights of the law-abiding citizens of Illinois,” concluded Brown.
