NAGR Opposes H.R. 1808, “Assault” Weapons Ban

Rep. Jerry Nadler Announced Markup on H.R. 1808 for Wednesday, July 20th

Washington, D.C. – This morning, House Judiciary Chairman Jerry Nadler (D-NY) announced a markup hearing for H.R. 1808, the Assault Weapons Ban of 2021, for Wednesday, July 20, 2022. The bill, sponsored by Rep. David Cicilline (D-RI) has 211 cosponsors, all democrats. If signed into law, H.R. 1808 would ban nearly all semi-automatic weapons and standard-capacity magazines.

“It hasn’t even been a month since Biden signed the largest gun control package in 30 years and Democrats are already back asking for more – just as we warned,” said Dudley Brown, President of the National Association for Gun Rights. “This blatantly unconstitutional bill is a proverbial middle finger to law-abiding gun owners and to the United States Constitution, itself. The so-called ‘assault’ weapons targeted by this legislation have been common in households for a century.”

The United States House of Representatives hasn’t held a roll call vote on an Assault Weapons Ban bill since Sen. Dianne Feinstein’s 1994 Assault Weapons Ban, which was in effect for ten years. The ban was in effect when the 1999 Columbine High School tragedy occurred.

Fourteen Republicans in the United States House of Representatives crossed party lines to vote with Democrats to pass the Bipartisan Safer Communities Act last month. Two Republicans, Rep. Adam Kinzinger (R-IL) and Rep. Chris Jacobs (R-NY) have expressed interest in supporting an “assault” weapons ban. 

Last month, the Supreme Court issued a ruling in the case of New York State Rifle & Pistol Association v. Bruen. In the Opinion of the Court, the Supreme Court created a new test for the Constitutionality of gun control provisions, in which text, history, and tradition must be the standard when considering state and federal gun control.

“Congress is now considering legislation which the Supreme Court has already deemed unconstitutional. This new ‘Assault’ Weapons ban fails the Bruen test on all three standards of text, history, and tradition of the Second Amendment. We are already suing at the state level on similar legislation, and we will be more than happy to sue Biden for any federal ban,” concluded Brown.


The National Association for Gun Rights opposes all federal gun control legislation and is calling on the U.S. House of Representatives to vote NO on the Assault Weapons Ban of 2021.  The National Association for Gun Rights is asking its 4.5 million members to call the Congressional Switchboard and tell them to oppose all gun control in the U.S. House.
