Pennsylvania Gun Rights Demands PA Attorney General Uphold State Preemption Law

Harrisburg, PA – Pennsylvania Gun Rights, the state affiliate of the National Association for Gun Rights – announced that they have issued a demand to the Attorney General of Pennsylvania to enforce state preemption of firearm law.

On August 26, 2024, the City Council of Reading, PA passed an ordinance banning the lawful manufacture of privately made firearms using modern technology such as three-dimensional printing and firearm parts.

“The unlawful actions by Reading’s elected officials run afoul of the U.S. Constitution, the Pennsylvania Constitution, the Pennsylvania Crimes Code, as well as Supreme Court precedent,” explained Craig Storrs, Jr., Executive Director for Pennsylvania Gun Rights.

The City of Reading is subject to the laws of the Commonwealth of Pennsylvania, which disallows any county, municipality, or township from regulating the landscape of firearms.”

Pennsylvania Gun Rights put Pennsylvania Attorney General Michelle Henry on notice of the City of Reading’s unconstitutional actions with the reminder she is to block the enforcement of this ban.

“As Attorney General of the Commonwealth of Pennsylvania, it is Michelle Henry’s duty to enforce the Constitution of the United States, the Constitution of Pennsylvania and all applicable laws, failure to do so here will be considered a significant breach of Michelle Henry’s oath,” Storrs warned.

According to 18 PA. C.S. §6120, the General Assembly expressly forbids municipalities from infringing upon the landscape of firearm regulation, meaning Reading is in violation of numerous aspects of the law. 

“The question begged now is, will Michelle Henry honor her oath? Or will she continue to ignore law and order to once again appease far-left Democrats in Harrisburg by turning a blind eye to the City of Reading openly disregarding state law?” Storrs concluded.
